Acceptable use
Do not use RevenuePilot for unlawful, deceptive, harassing, age-gated, lending, gambling, cannabis, firearms, or high-risk messaging without proper carrier approvals.
Do not upload contacts who opted out, did not consent to receive the intended messages, or were obtained from purchased or scraped lists.
Do not attempt to circumvent rate limits, signature checks, or compliance gates. Do not probe the service for vulnerabilities outside our security disclosure process.
Intellectual property
RevenuePilot, including the software, design, content, and trademarks, is owned by RevenuePilot and its licensors. You receive a limited, non-exclusive, non-transferable license to use the service while your subscription is active.
You retain ownership of your customer records and message content. You grant us the limited license needed to host, process, and deliver that content as part of providing the service.
Billing and availability
Paid plans and any usage-based messaging costs are billed through Stripe and our messaging partners. Subscriptions renew automatically unless cancelled.
The service may be unavailable during maintenance, partner outages, or required account reviews. We do not guarantee uninterrupted access.
You may cancel at any time from the customer billing portal. Cancellations take effect at the end of the current billing period; we do not pro-rate refunds for partial periods unless required by law.
Termination
You may close your account at any time. We may suspend or terminate accounts that violate these terms, threaten the security of the service, or fail to keep their billing current.
On termination we will retain only the records required to meet legal obligations, resolve disputes, and maintain opt-out evidence.
Disclaimers
RevenuePilot is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that messages will be delivered, that any specific customer will respond, or that the service will be free of errors.
Limitation of liability
To the fullest extent permitted by law, RevenuePilot is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to use of the service.
Our total cumulative liability for all claims arising out of or related to the service will not exceed the greater of (a) the amounts you paid to RevenuePilot in the 12 months before the event giving rise to liability, or (b) one hundred U.S. dollars.
Indemnity
You will defend, indemnify, and hold harmless RevenuePilot and its officers, directors, employees, and agents from any claim, demand, or expense (including reasonable attorneys' fees) arising from your use of the service, your customer records, your message content, your consent practices, or your violation of these terms or applicable law (including TCPA, CAN-SPAM, and state privacy laws).
Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules.
Any dispute will be resolved in the state or federal courts located in Delaware. Each party waives any right to a jury trial.
